System Diagnostic Contract

  1. Purpose
    This document is intended to form an agreement for a professional Coaching relationship between the Client (“you”, “your”) and Justin Clark (“me”, “I”).Failure by either party to adhere to this agreement may lead to the termination of the agreement. This agreement is subject to renegotiation at any stage of the working relationship by agreement of both parties.

  2. Sessions
    We have agreed to meet online for a one-off 90-minute session System Diagnostic session, at the date and time selected by you.

  4. Fees
    Coaching fees are:£375 per session. There is no VAT payable.

  5.  Cancelling, Rescheduling, and Non-Attendance
    - All cancellation requests must be made in writing (email is acceptable) to justin@justinclark.coach.
    - Refunds, where applicable, will be processed within 14 working days of approval and will be made using the original payment method.
    - Cancellation by the Client:
    - - - Individual appointments cancelled with more than 72 hours' notice: If you cancel a session with more than 72 hours' notice, you may reschedule the session at no additional cost, subject to availability. Alternatively, you may request a full refund for that specific session.
    - - - Individual appointments cancelled with less than 72 hours' notice: If you cancel a session with less than 72 hours' notice, the session will be forfeited, and no refund will be issued. I may, at my sole discretion, offer partial credit or allow rescheduling in exceptional circumstances.
    - If you arrive late to a session, we will still need to finish at the planned time.
    - No-Shows: If you do not attend a scheduled session without any prior notice ("no-show"), the session will be forfeited, and no refund or credit will be issued.

  6. Confidentiality and Ethical Practice
    - All information about the Coach (me)/Client (you) relationship and any written notes will be treated by me as confidential.
    - I am a member of the European Mentoring & Coaching Council (EMCC) and work to their ethical standards and code of conduct as detailed in the Global Code of Ethics (https://www.globalcodeofethics.org).
    - There are times when your information will be shared with others as outlined below:
    - - - I have a responsibility and commitment to work under regular supervision. This means that I will share and discuss some of the information from sessions with my supervisor and occasionally with peers, always within a strictly confidential and professional framework. Similar professional commitments and confidentiality agreements bind external supervisors and will only know you by your first name or initials.
    - - - Confidentiality may be broken (i.e. I will share information about you with relevant people) when there is evidence or serious concern that you may harm yourself or others, or when directed by the law. In these instances, I could contact the appropriate services or individuals without your consent. You will be informed in advance whenever possible, and only in case of an imminent threat or potential for harm might I make this decision without consulting you. In all other cases, your information will be shared and/or requested only with your consent.

  7. Accreditation, Professional Development, Publication, and Research
    - As part of my Continuing Professional Development and ongoing Accreditation requirements, anonymised examples from my work with you may be used for publication, research, and academic purposes.
    - - - This includes but is not limited to brief examples, extracts, vignettes, and case studies, which may include biographical information such as age and gender.
    - - - All such use will be anonymised as far as is possible, and the use of any identifiable material will only take place with your explicit consent.
    - - - I may ask your permission to use any feedback you provide as testimonials in my marketing materials.

  8. Privacy Policy and GDPR
    This Agreement should be read alongside the separate Privacy Policy (available at https://www.justinclark.coach/privacy-policy), which includes information on storing, processing, and sharing your data in line with the General Data Protection Regulation (GDPR) legislation.

  9. Complaints and Misunderstandings
    - An important part of the Coaching relationship is my role in providing challenge and encouraging you to push yourself.  However, this must always be done sensitively and appropriately.
    - If I say or do something that upsets you or does not feel right, please let me know.  I want to provide you with the service and support you need, and believe that honesty and trust are critical for our relationship to grow.
    - I want this to be an open and safe professional relationship for you to come with confidence, and ask that you let me know if there is ever anything that you are concerned about in our work together, so that I can do what is necessary for you to be satisfied.
    - If you have any complaints about me or the service I provide, please let me know clearly. I will try to put things right if I can, and in any case, explain how you could make a formal complaint to the EMCC UK via the email address info@emccuk.org.
